Описание: David Eagleman`s bestselling, sparkling and provocative book on neuroscience now part of the Canongate Canons series
In this provocative book, Paul Glimcher argues that economic theory may provide an alternative to the classical Cartesian model of the brain and behavior. Glimcher argues that Cartesian dualism operates from the false premise that the reflex is able to describe behavior in the real world that animals inhabit. A mathematically rich cognitive theory, he claims, could solve the most difficult problems that any environment could present, eliminating the need for dualism by eliminating the need for a reflex theory. Such a mathematically rigorous description of the neural processes that connect sensation and action, he explains, will have its roots in microeconomic theory. Economic theory allows physiologists to define both the optimal course of action that an animal might select and a mathematical route by which that optimal solution can be derived. Glimcher outlines what an economics-based cognitive model might look like and how one would begin to test it empirically. Along the way, he presents a fascinating history of neuroscience. He also discusses related questions about determinism, free will, and the stochastic nature of complex behavior.

Описание: This volume makes a contribution to the field of neurolaw by investigating issues raised by the development, use, and regulation of neurointerventions. The broad range of topics covered in these chapters reflects neurolaw's growing social import, and its rapid expansion as an academic field of inquiry. Some authors investigate the criminal justice system's use of neurointerventions to make accused defendants fit for trial, to help reform convicted offenders, or to make condemned inmates sane enough for execution, while others interrogate the use, regulation, and social impact of cognitive enhancement medications and devices. Issues raised by neurointervention-based gay conversion therapy, efficacy and safety of specific neurointervention methods, legitimacy of their use and regulation, and their implications for authenticity, identity, and responsibility are among the other topics investigated. Dwelling on neurointerventions also highlights tacit assumptions about human nature that have important implications for jurisprudence. For all we know, at present such things as people's capacity to feel pain, their sexuality, and the dictates of their conscience, are unalterable. But neurointerventions could hypothetically turn such constants into variables. The increasing malleability of human nature means that analytic jurisprudential claims (true in virtue of meanings of jurisprudential concepts) must be distinguished from synthetic jurisprudential claims (contingent on what humans are actually like). Looking at the law through the lens of neurointerventions thus also highlights the growing need for a new distinction -- between analytic jurisprudence and synthetic jurisprudence -- to tackle issues that increasingly malleable humans will face when they encounter novel opportunities and challenges.

Описание: This textbook offers a foundation for understanding adolescents’ rights by articulating the complexity, breadth, and challenging nature of laws regulating adolescents. It showcases the Supreme Court’s key interpretations of the Constitution as it relates to adolescents’ rights. Chapters examine relevant legal systems and the social contexts that legal systems control. In addition, chapters discuss constitutional issues and their nuances through actual cases that often offer alternative interpretations of constitutional rules. The textbook guides readers through both well accepted and often ignored conceptions of adolescents’ rights. It offers readers unfamiliar with the law the tools they need to understand the importance of adolescents’ constitutional rights and how they can contribute to developing them.Topics featured in this text include: The role of parents and family systems in conceptualizing adolescents’ rights. The complexities of providing health care to adolescents.Religious freedom and adolescents’ rights relating to religion. The flaws of child welfare systems. The challenge of developing rights specifically for juveniles and delinquent youth.Juvenile court systems and the differential treatment of adolescents. The difference between the juvenile court system and the criminal court system.Adolescents’ media rights.Adolescents and Constitutional Law is an essential textbook for graduate students as well as a must-have reference for researchers/professors and related professionals in developmental psychology, juvenile justice/youth offending, social work, psychology and law, family studies, constitutional law, and other interrelated disciplines.
