Описание: In The Prescription-to-Prison Pipeline Michelle Smirnova argues that the ongoing opioid drug epidemic is the result of an endless cycle in which suffering is medicalized and drug use is criminalized. Drawing on interviews with eighty incarcerated individuals in Missouri correctional institutions, Smirnova shows how contradictions in medical practices, social ideals, and legal policies disproportionately criminalize the poor for their social condition. This criminalization further exacerbates and perpetuates drug addiction and poverty. Tracing the processes by which social issues are constructed as biomedical ones that necessitate pharmacological intervention, Smirnova highlights how inequitable surveillance, policing, and punishment of marginalized populations intensify harms associated with both treatment and punishment, especially given that the distinctions between the two have become blurred. By focusing on the stories of people whose pain and pharmaceutical treatment led to incarceration, Smirnova challenges the binary of individual and social problems, effectively exploring how the conceptualization, diagnosis, and treatment of substance use may exacerbate outcomes such as relapse, recidivism, poverty, abuse, and death.

Описание: If the Al-Qaeda terrorists who attacked the United States in 2001 wanted to weaken the West, they achieved their mission by striking a blow at the heart of democracy. Since 9/11 governments including those of the USA, the UK, France and Australia have introduced tough, intimidating legislation to discourage the legitimate activities of a probing press, so greatly needed after the Iraq War proved that executive government could not be trusted. Often hiding behind arguments about defending national security and fighting the war on terror, governments criminalised legitimate journalistic work, ramping up their attacks on journalists’ sources, and the whistle-blowers who are so essential in keeping governments honest. Through detailed research and analysis, this book, which includes interviews with leading figures in the field, including Edward Snowden, explains how mass surveillance and anti-terror laws are of questionable value in defeating terrorism, but have had a ‘chilling effect’ on one of the foundations of democracy: revelatory journalism.

While the `need` to enhance `youth political participation` is promoted, the cases in this book document how states are using everything from surveillance
Описание: The first book to develop an in-depth analysis of how legal and political ideas concerning the criminalization of racial violence have evolved from slavery to the present, and to offer new historical and theoretical perspective for analyzing limits of current attempts to use criminal legislation as a weapon against racism.
Описание: In the late nineteenth century, progressive reformers recoiled at the prospect of the justice system punishing children as adults. Advocating that children's inherent innocence warranted fundamentally different treatment, reformers founded the nation's first juvenile court in Chicago in 1899. Yet amidst an influx of new African American arrivals to the city during the Great Migration, notions of inherent childhood innocence and juvenile justice were circumscribed by race. In documenting how blackness became a marker of criminality that overrode the potential protections the status of ""child"" could have bestowed, Tera Eva Agyepong shows the entanglements between race and the state's transition to a more punitive form of juvenile justice.
This important study expands the narrative of racialized criminalization in America, revealing that these patterns became embedded in a justice system originally intended to protect children. In doing so, Agyepong also complicates our understanding of the nature of migration and what it meant to be black and living in Chicago in the early twentieth century.
Winner of the 2013 John Hope Franklin Book Prize presented by the American Studies Association A necessary read that demonstrates the ways in which certain people are devalued without attention to social contexts Social Death tackles one of the core paradoxes of social justice struggles and scholarship—that the battle to end oppression shares the moral grammar that structures exploitation and sanctions state violence. Lisa Marie Cacho forcefully argues that the demands for personhood for those who, in the eyes of society, have little value, depend on capitalist and heteropatriarchal measures of worth. With poignant case studies, Cacho illustrates that our very understanding of personhood is premised upon the unchallenged devaluation of criminalized populations of color. Hence, the reliance of rights-based politics on notions of who is and is not a deserving member of society inadvertently replicates the logic that creates and normalizes states of social and literal death. Her understanding of inalienable rights and personhood provides us the much-needed comparative analytical and ethical tools to understand the racialized and nationalized tensions between racial groups. Driven by a radical, relentless critique, Social Death challenges us to imagine a heretofore “unthinkable” politics and ethics that do not rest on neoliberal arguments about worth, but rather emerge from the insurgent experiences of those negated persons who do not live by the norms that determine the productive, patriotic, law abiding, and family-oriented subject.
Описание: Lava Jato, a transnational bribery case that started in Brazil and spread throughout Latin America, upended elections and collapsed governments. Why did the investigation gain momentum in some countries but not others? The book traces reforms that enhanced prosecutors' capacity to combat white-collar crime and shows that Lava Jato became a full-blown anti-corruption crusade where reforms were coupled with the creation of aggressive taskforces. For some, prosecutors' unconventional methods were necessary and justified. Others saw dangerous affronts to due process and democracy. Given these controversies, how did voters react to a once-in-a-generation attempt to clean politics? Can prosecutors trigger hope, conveying a message of possible regeneration? Or does aggressive prosecution erode the tacit consensus around the merits of anti-corruption? Prosecutors, Voters and The Criminalization of Corruption in Latin America is a study of the impact of accountability through criminalization, one that dissects the drivers and dilemmas of resolute transparency efforts.

Описание:
Drawing on case studies from around the world, contributors to this ground-breaking book explore a major contemporary paradox: on the one hand, young people today are at the forefront of political campaigns promoting social rights and ethical ideas that challenge authoritarian orders and elite privileges. On the other hand, too many governments, some claiming to be committed to liberal-democratic values, social inclusion and youth participation are engaged in repressing political activities that contest the status quo.
Contributors to this book explore how, especially since 9/11, governments, state agencies and other traditional power holders around the globe have reacted to political dissent authored by young people. While the 'need' to enhance 'youth political participation' is promoted, the cases in this book document how states are using everything from surveillance, summary offences, expulsion from universities, 'gag laws' and 'antiterrorism' legislation, and even imprisonment to repress certain forms of young people's political activism. These responses diminish the public sphere and create civic spaces hostile to political participation by any citizen.
This book forms part of The Criminalization of Political Dissent series. It documents and interprets the many ways contemporary governments and agencies now routinely use various techniques to repress and criminalise political dissent.
