Stephanie Malia Hom focuses on Libya, considered Italy's most valuable colony, both politically and economically. Often perceived as the least of the great powers, Italian imperialism has been framed as something of "colonialism lite." But Italian colonizers carried out genocide between 1929–33, targeting nomadic Bedouin and marching almost 100,000 of them across the desert, incarcerating them in camps where more than half who entered died, simply because the Italians considered their way of life suspect. There are uncanny echoes with the situation of the Roma and migrants today. Immigration detention is considered by many states to be a necessary tool in the execution of immigration policy. Despite the apparently key role it plays in immigration enforcement, the law on immigration detention is often vague, especially in relation to determining the circumstances under which prolonged detention remains lawful. As a result, the courts are frequently called upon to adjudicate these matters, with scant legal tools at their disposal. Though there have been some significant judgments on the legality of detention at the constitutional level, the extent to which these judgments have had an impact at the lower end of the judiciary is unclear. Indeed, it is the lower courts which are tasked with judging the legality of detention through habeas corpus or judicial review proceedings.
This book examines the way this has occurred in the lower courts of two jurisdictions, the UK and the US, and contrasts this practice not only in those jurisdictions, but with judgments rendered by the Court of Justice of the European Union, a constitutional court at the other end of the judicial spectrum whose judgments are applied by courts and tribunals in the EU Member States. Although these three jurisdictions use similar tests to evaluate the legality of detention, case outcomes significantly differ. Many factors contribute to this divergence, but key among them is the role that fundamental rights protection plays in each jurisdiction. Through a forensic evaluation of 191 judgments, this book compares the laws on detention in the UK, US and EU, and makes recommendations to these jurisdictions for improvement.

Описание: The purpose of this report is to comprehensively examine the U.S. Government's compliance with federal immigration laws and detention policies, and also detail evidence regarding possible infringement upon the constitutional rights afforded to detained immigrants. More specifically, this report examines the Department of Homeland Security (DHS) and its component agencies' treatment of detained immigrants in immigration holding, processing, and detention centers throughout the United States.Prior to writing this report, the Commission gathered facts and data to analyze whether DHS, its component agencies, and private detention corporations with whom the federal government contracts to detain immigrants were complying with the Performance Based National Detention Standards, Prison Rape Elimination Act Standards, the Flores Settlement Agreement and other related immigrant child detention policies, and the United States Constitution. During the Commission's January 30, 2015 briefing, the Commission received written and oral testimony from DHS immigration detention officials and advocates detailing the strengths, weaknesses, and constitutional and civil rights implications of the U.S. immigration detention system. In May 2015, the Commission visited Karnes Family Detention Center and Port Isabel Detention Centers - both located in Texas - to corroborate the written and oral evidence the Commission gathered. The Commission believes that this report is both instructive and useful to the U.S. Government and the public at large as a contribution to the public dialogue surrounding civil rights and constitutional issues in the U.S. immigration detention system. The Commission is confident that this report will aid in the ultimate resolution of those issues, and that one day the United States may truly live up to its reputation of being the land of the free.
