Описание: This book provides a normative analysis of the justifications and limits of asset confiscation as a crime control measure in a comparative perspective. More specifically, it deals with what in this context is referred to as extended appropriation, that is, confiscation in cases where the causal link between the property (the proceeds of crime) in question and the predicate offence(s) is less obvious. Particular focus is placed on extended criminal confiscation and civil recovery. These forms of confiscation give rise to a number of complex legal issues. The overarching purpose of the book is to provide an analysis of the nature of extended appropriation within the criminal justice system and to discuss a normative framework that may assist in assessing the legitimacy of such confiscation schemes. It also seeks to explore what a fair and reasonable balance between the interests of the state and those of the individual in this field might look like. The analysis starts from an acknowledgement not only of the need for having effective confiscation regimes in place, but also of the need for protecting the interests of the individual. It is hoped that the book will stimulate further discussion on the legitimacy of asset recovery as a crime control measure.

It takes a mutiny carried out by a group of convicts and sailors on board a Danish ship, the Merman, in 1683 as its central case study. En route to Denmark’s Caribbean colony of St. Thomas, the mutineers seized the ship, murdered the captain and six others and elected a former convict as their new leader. This event brought the West India Company to the brink of destruction and changed the course of the fledgling Danish maritime empire forever. Arguing that the mutiny on the Merman was informed by stories and rumour that circulated on both sides of the Atlantic and echoed on the lower deck of the ship itself, Johan Heinsen explores the role of such stories in the social worlds of early modern colonialism. He argues that sites such as ships, colonies and even prisons resonated with words, paying particular attention to how such storytelling created bonds and enabled action. In making the point that historians should pay careful attention to the power of the words of colonial and maritime lower class subjects, Heinsen draws on comparable cases across the early modern seas. Heinsen’s study brings the Danish Empire to a new Anglophone audience, expanding our knowledge of the Atlantic world. Johan Christensen examines one major contributor to this disparity: the entrenchment of U.S.-trained, neoclassical economists in political institutions the world over. While previous studies have highlighted the role of political parties and production regimes, Christensen uses comparative case studies of New Zealand, Ireland, Norway, and Denmark to show how the influence of economists affected the extent to which each nation adopted market-oriented tax policies. He finds that, in countries where economic experts held powerful positions, neoclassical economics broke through with greater force. Drawing on revealing interviews with 80 policy elites, he examines the specific ways in which economists shaped reforms, relying on an activist approach to policymaking and the perceived utility of their science to drive change.
